Wrongful death: Wrong drug resulted in fatality, lawsuit

When working in any sort of medical care facility, health care providers in New Jersey are expected to ensure that any medication given to a patient is necessary and administered appropriately. In fact, many facilities have several measures in place to track medication and ensure that the right patient receives the correct medication. Unfortunately, a resident at an out-of-state nursing home facility passed away; a recent wrongful death lawsuit claims it was because of a medication error.

The incident that allegedly led to the elderly patient's death reportedly occurred in June 2015, only months after the man had become a patient at the Greenbriar Health Care Center. The family of the now-deceased man claims that on a day in late June, the man was given extended release morphine -- a medication that was not prescribed to him. A recently filed lawsuit claims that the family of the man was not notified about the mistake.

Unfortunately, he was unresponsive the next morning and transported to the hospital. Despite being transferred to the hospital, the man passed away. Three employees now face criminal charges as a result. Charges include patient abuse and tampering with records.

The family is seeking in excess of $25,000 as a result of the man's death. The lawsuit claims that the man could have been expected to live approximately 13 more years. Families in New Jersey who have lost a loved one as result of medical malpractice at a nursing home facility often also make the decision to file a wrongful death lawsuit. While a verdict in their favor may not reduce their grief, a financial award will likely leave them better prepared to handle the financial ramifications of their loss.
