Alcohol-related car accidents potentially lead to needless deaths

Far too many people die on New Jersey's roadways each year due to a variety of reasons. Few crashes are more preventable than the ones involving alcohol. Unfortunately, the news is full of stories about such tragedies. When drivers choose to get behind the wheel and drive after drinking, the potential for being involved in fatal car accidents increases exponentially.

A 29-year-old man should have considered this factor before he drove early one morning. At approximately 6:27 a.m. that morning, he crashed his vehicle, and another person paid the price. The 20-year-old victim -- who was not identified at last report while officials attempted to inform his next of kin -- suffered fatal injuries as a result of the accident.

Police arrested the driver on suspicion of driving under the influence and now faces charges for that offense, along with death by auto. If prosecutors secure a conviction on the charges, the New York man could spend up to 10 years in prison. He would be required to serve a minimum of five of those 10 years.

The man's possible incarceration need not deter the victim's family from filing a wrongful death claim. If the evidence establishes that the death of their loved one was caused by the allegedly intoxicated driver's actions, a New Jersey court could enter an award of damages allowable in car accidents under state law. In addition to assisting the family in obtaining a monetary judgment, an attorney could also pursue all appropriate collection methods on their behalf both now and in the future.
