Medical malpractice lawsuit filed against troubled facility

Most families want to ensure that their loved ones receive appropriate care when they become unable to care for themselves. As a result, some choose to seek the assistance of a nursing home. While they do so trusting that the facility will provide adequate care, many people in New Jersey and across the country find that their loved ones have fallen victim to abuse and neglect. A recent medical malpractice lawsuit filed in another state illustrates the issues that some patients face.

The lawsuit involves a nursing home facility that was inspected by the state last year. As a result of the inspection, the facility was banned from accepting new patients. A follow-up inspection revealed additional serious violations. The facility was only allowed to admit new patients in December.

However, the son of a patient at the facility claims that he was never notified about the issues. Although he received a phone call from the facility to ask if he had any concerns, he claims that he was only told that the phone call was part of an audit. However, he claims that he only later learned that his father was one of the patient's flagged due to the care he received.

As a result, the man is seeking over $100,000 in damages. He has made several accusations against the facility, including that it failed to prevent his father from falling, it did not adequately treat his pain, did not ensure that he could use his call button and allowed him to contract MRSA, among others. The facility's manager denies the accusations and claims that they are ready to fight the case in court.

Families in New Jersey should be able to have confidence that their loved ones will receive the care they need when they are placed in nursing home facilities. Unfortunately, this is not always the case. Some suffer irreparable harm due to neglect, abuse and other forms of medical malpractice. To ensure that responsible parties are held accountable for such treatment, many victims and their families choose to file a civil lawsuit.
