Property owners may be held liable for fall-down accidents

The owners of public properties in New Jersey are responsible for ensuring the safety of the people who enter the property. The failure to take the necessary precautions to eliminate --or at least reduce -- any hazards that could cause fall-down accidents could result in serious injury or death. If you were injured or lost a family member due to dangerous property, you may file a civil action attempting to hold the owner liable for your injuries or the death of your family member.

Property owners are responsible for ensuring that there is adequate lighting on the premises to ensure that the people who enter the premises are able to see where they are going. Floors, parking lots and the grounds on which people walk need to be kept in good repair and free of uneven surfaces. In the winter, failure to clear ice and snow could also cause people to slip and fall.

Falling merchandise, spilled food or beverages and other hazards that could arise during the course of the business day also need to be cleared by employees within a reasonable amount of time after they are discovered. Periodic inspections of the premises should be made in order to ensure that no hazards exist that could endanger anyone on the property. Every accident is different, but the duty of care owed to you or someone you love is the same.

If you suffer a serious injury or a loved one dies because of a slip and fall, the property's owner -- and possibly other parties -- can be held liable. It is necessary to prove negligence in fall-down accidents before a New Jersey court will consider an award of damages. Seeking the advice and assistance of an attorney could help determine the merits of your case and ensure that you receive a judgment that provides you with the financial restitution to which you are entitled.
