Medical malpractice suit alleges neglect led to woman's death

It is difficult for both patients and their families when they a person must be placed in a New Jersey nursing home. In many cases, patients are unable to express their needs, and families are left wondering about the care given. These families are often left with no other choice but to trust that the nursing home staff will take appropriate care of their family member. Unfortunately, one out-of-state medical malpractice lawsuit alleges that negligence by staff members at a nursing home led to a woman's death.

A lawsuit was filed against the facility by the woman's daughter. The daughter claims that her mother was a resident at the facility for approximately four years. During that time, the patient reportedly suffered multiple falls, often from her bed.

Reports indicate that the woman was discovered, deceased, one morning; she had apparently fallen from her bed. Employees found her on her knees with her chin resting on her mattress. The plaintiff in the case claims that nursing home employees informed her that her mother likely passed away due to a heart attack or other similar issue as a result of the distress she felt from the fall. However, an autopsy revealed that she died as a result of positional asphyxiation -- that is, as a result of the position of her head. Subsequent investigations supported these claims.

A representative for the woman's daughter claims that the patient would still be alive today if it weren't for the neglect of staff at the nursing home. Unfortunately, those who lose a loved one due to medical malpractice have few paths to recourse. One option for those in New Jersey and across the country is to file a civil lawsuit. A successfully presented case could result in not only a monetary award but also justice for families who have needlessly suffered as a result of negligence on the part of health care professionals.
