Sorting out liability in multi-car accidents not necessarily an easy matter, P.1

Around 15 individuals received minor injuries over the weekend after they were involved in a multi-car accident on the New Jersey Turnpike. The incident reportedly involved a total of ten vehicles, though it isn’t clear yet what caused the crashes. One driver reportedly pointed to congestion on the turnpike due to construction.

In any car accident case, it is crucial for accident victims who have suffered serious injury to seek the compensation they deserve from the driver or drivers responsible for those injuries. One of the initial steps that must be taken to do this is to identify liable parties. When an accident only involves two vehicles, this is a more or less straightforward task. When multiple vehicles are involved, things can quickly get complicated. 

One of the complications in determining liability in multi-car crashes is that it can be difficult to get the facts straight. Perception and perspective aren’t going to be uniform across all those involved in a single incident, and individuals will likely come away with a different memory of the crash. Memory can be a tricky thing to deal with when it comes to accuracy, since emotion can get in the way. Sorting out exactly how the crash initially occurred, and how it progressed as more drivers became involved, is not going to necessarily be an easy matter.

Another reason why sorting out liability in multi-car accidents can be difficult is that the legal issues of duty and causation may not be clear, even if the facts are. We’ll say more about this in our next post.
