Will wrongful death claim be filed re fatal single-car crash?

Passengers put their lives in the hands of drivers every day. They trust them to navigate New Jersey's roads safely and get them to their destinations in one piece. However, when something goes wrong, accident victims may be seriously injured or even die. After a fatal crash, surviving family members might exercise their right to file a wrongful death claim against the party or parties believed responsible for the loss of their loved ones.

Time will tell whether the family of passenger recently killed in a single-car accident on Route 18 North will pursue a claim for financial redress. When police responded to the scene, which was near the Route 27 exit, they discovered a vehicle in the river. One of its occupants, the 22-year-old driver, was found outside the vehicle. Officers attempted to revive the unconscious man, but he succumbed to his injuries. The 21-year-old passenger was still in the vehicle; he, too, was deceased.

Preliminary reports indicate that the driver somehow lost control at around 1:40 a.m. on a Monday morning. The vehicle slammed into a guardrail before careening through the woods. It finally came to rest in the Raritan River. Officials remained at the scene for approximately four hours, but the investigation is ongoing.

While investigators work to discover what happened, the family of the passenger may exercise their right to file a wrongful death claim against the estate of the deceased driver. If they are able to document through appropriate evidence that he was negligent, an award of damages could be made by a New jersey civil court. Any restitution received by the family could help with the financial losses incurred and could provide them with some closure and justice on behalf of their loved one.
