At-fault drivers may be held responsible in car accidents

Most New Jersey drivers understand that they owe a duty to their passengers to get them to their destination without accident or injury. When that duty is breached, drivers can be held responsible for their negligent actions through the filing of a personal injury claim by a passenger or a wrongful death claim by the family of a deceased passenger. Car accidents are caused by any number of factors, evidence of which can be used to prove negligence in a court of law.

Sometime prior to 1:49 a.m. on a recent Friday morning, a trooper with the New Jersey State Police began following a vehicle that he considered to be moving in an erratic manner. The trooper remained some distance behind the vehicle and did not turn on the patrol car's lights and sirens at first. After observing the vehicle for some time, the trooper turned on the emergency lights and began to catch up with the car in order to stop the driver.

It was then that the vehicle left the highway, overturned and slammed into a guardrail. The man driving the car and his two passengers, both women, were taken to an area hospital. The current condition of the driver and one of the passengers is not known, but the third occupant of the vehicle was listed as being in critical condition at last report.

The passengers retain the right to file personal injury claims against the driver since they are undoubtedly incurring a significant amount of medical bills, lost wages and other damages. Other parties might also be brought into these lawsuits depending on whether an investigation into the circumstances surrounding the crash warrants it. If negligence on the part of one or more defendants is established, damages typically seen in car accidents could be awarded.
